787 Pilates Studio Terms of Service & Waiver

These Terms of Service ("Terms") apply to your use of the 787 Pilates Studio ("787 Pilates," "we," "us," or "our") website, mobile application, class booking services, memberships, class packages, and studio services. By creating an account, making a purchase, booking or attending a class, or otherwise using our services, you agree to these Terms.

Accounts and Bookings

Customers may be required to create an account to purchase memberships or class packages and reserve classes.

You are responsible for keeping your account information accurate and for activity through your account. Class availability is not guaranteed and is subject to capacity, scheduling, instructor availability, and studio operations.

Purchases, Memberships, and Class Packages

Prices for classes, memberships, packages, merchandise, beverages, and other services are shown at the time of purchase and may be subject to applicable taxes. Memberships and packages are subject to the billing terms, expiration dates, and other conditions disclosed at purchase. 787 Pilates may change future pricing, schedules, offerings, and membership options.

Class Pack Rules

5-Class Pack: Valid for 3 months from the date of purchase. 10-Class Pack: Valid for 6 months from the date of purchase. Class-pack credits must be used before the applicable expiration date. Unused credits expire at the end of the validity period. Class packs do not automatically renew, may not be shared or transferred to another person, and are non-refundable except where otherwise required by applicable law. All reservations made with a class pack remain subject to studio booking, cancellation, late-cancellation, and no-show policies.

Cancellations and No-Shows

Class reservations must be canceled at least 12 hours before the scheduled class time to avoid a late-cancellation charge. A late cancellation may result in a $15 late-cancellation fee. Failure to attend a reserved class without properly canceling may result in a $20 no-show fee. Applicable fees and policies may also be displayed during booking or within your account.

Studio Rules and Conduct

Customers are expected to follow studio rules, instructor directions, safety instructions, and respectful standards of conduct. 787 Pilates may refuse or discontinue service when reasonably necessary to protect the safety, wellbeing, or experience of customers, instructors, staff, or others.

Health, Fitness and Assumption of Risk

Pilates, fitness classes, exercise programs, and related activities involve inherent risks of physical activity. By participating, you acknowledge that you are voluntarily engaging in physical exercise and accept the ordinary risks associated with it. You are responsible for determining whether participation is appropriate for you and for informing your instructor of relevant limitations, injuries, pregnancy, or other circumstances that may affect safe participation. Stop exercising and seek appropriate medical attention if you experience concerning symptoms. To the extent permitted by applicable law, you voluntarily assume the risks inherent in participating in 787 Pilates classes and activities. Nothing in these Terms is intended to waive rights or liabilities that cannot legally be waived.

Personal Property

787 Pilates is not responsible for lost, stolen, or damaged personal belongings except to the extent responsibility cannot be excluded under applicable law. Customers are responsible for securing their belongings while at the studio.

SMS/Text Messaging Terms

1. Program Description

By opting in, you agree to receive recurring automated text messages from 787 Pilates Studio ("we," "us," "our") at the mobile number you provided. Messages may include appointment and class reminders, booking updates, account alerts, studio updates, promotional offers, and customer support follow-ups. Consent to receive these messages is not a condition of any purchase.

3. Message and Data Rates

Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging plan.

4. How to Opt Out and Get Help

You can unsubscribe from the SMS service at any time by replying STOP to any message we send you. After you send STOP, you will receive a one-time confirmation message, and no further messages will be sent. If you want to rejoin, you can sign up again using the original opt-in method or reply START. For help or more information at any time, reply HELP to any of our messages. 5. Carrier Liability Disclaimer

Carriers are not liable for any delayed or undelivered messages.

Intellectual Property

The 787 Pilates name, branding, logos, website content, application content, photographs, graphics, and other proprietary materials may be protected by intellectual-property laws and may not be copied, reproduced, distributed, or commercially used without authorization, except as permitted by law.

Availability and Changes to Services

We may modify class schedules, instructors, services, operating hours, digital features, pricing, or other offerings when reasonably necessary. We do not guarantee uninterrupted availability of our website, mobile application, booking platform, or other digital services.

Limitation of Liability

To the fullest extent permitted by applicable law, 787 Pilates will not be liable for indirect, incidental, special, or consequential damages arising from use of our digital services or participation in studio activities. Nothing in these Terms limits liability or consumer rights that cannot legally be limited or excluded.

Privacy

Your use of our services is also subject to the 787 Pilates Studio Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on our website with a revised effective date.
